Consumer Forum

In the context of law, a Consumer Forum is a quasi-judicial body established to address consumer grievances and disputes related to defective products or deficient services. These forums operate at different levels – District, State, and National – to provide a mechanism for consumers to seek redressal for unfair trade practices, defective goods, or unsatisfactory services. 

 

 

What are Consumer Forums?

Consumer forums, also known as Consumer Dispute Redressal Forums, are established under the Consumer Protection Act. 

Their primary function is to provide a platform for consumers to file complaints and seek resolution for issues arising from the purchase of goods or services. 

These forums are designed to be less expensive and faster than traditional court systems, ensuring easier access to justice for consumers. 

They have the power to investigate complaints, summon witnesses, and order compensation or other remedies to aggrieved consumers. 

 

Levels of Consumer Forums:

1. District Consumer Disputes Redressal Forum:

Handles complaints where the value of goods or services, along with the compensation claimed, does not exceed a specified amount (e.g., Rs. 20 Lac). 

 

2. State Consumer Disputes Redressal Commission:

Handles complaints where the value exceeds the District Forum's limit but is within another specified amount (e.g., up to Rs. 1 crore). 

 

3. National Consumer Disputes Redressal Commission:

Handles complaints where the value of goods or services, along with the compensation claimed, exceeds the limit of the State Commission (e.g., more than Rs. 1 crore). 

 

Key Features and Functions:

 

•Quasi-Judicial:

Consumer forums have powers similar to civil courts in certain aspects, like summoning witnesses, receiving evidence, and issuing commissions. 

 

•No Court Fee:

Generally, no court fee is required to file a complaint in a consumer forum. 

 

•No Lawyer Requirement:

While consumers can engage lawyers, it's not mandatory to present their case. 

 

•Fast Disposal:

Consumer forums aim to resolve disputes expeditiously. 

 

•Compensation:

If a complaint is upheld, the forum can order the seller or service provider to provide compensation to the consumer for the loss or injury suffered. 

 

•E-Filing:

In many cases, consumers can file complaints online through portals like the National Consumer Helpline or e-Daakhil portal, making the process even more convenient according to consumerhelpline.gov.in.
